GENERAL
MAC s.r.l., a company incorporated in Italy with registered address Via Montegrotto 160 - 35038 - Torreglia (Padova), Italy (hereinafter referred to as 'Archivio Jam On Line', or 'we'), sells products of the Archivio Jam branded collections directly to its customers through the website www.archiviojam.com (hereinafter referred to as 'Website'). Sale of the Products on the Website is subject to the following terms and conditions (hereinafter referred to as 'Terms of Sale').
2. CONSUMER INFORMATION
2.1. The Products on the Website are offered for sale exclusively to end customers (hereinafter referred to as 'Customer(s)' or 'you'). The term 'Customer' indicates any natural person who makes a purchase for purposes other than business, entrepreneurial, artisanal or professional ones. Purchase of the Products on the Website is permitted exclusively to persons of legal age, i.e. 18 years or over. The Products offered for sale on the Website may be purchased and shipped to Italy and the European Union.
2.2. Before confirming and sending a purchase order, you must thoroughly read and accept these Terms of Sale. Together with the Privacy Policy, these Terms of Sale govern all contracts between you and Archivio Jam for the sale of Products on the Website.
2.3. By sending the purchase order you accept and agree to be bound by these Terms of Sale. If you do not accept any of these Terms, you must not send a purchase order for Products on the Website.
3. PURCHASE PROCESS, ORDER ACCEPTANCE
3.1. To purchase one or more Products, you must select the Products, together with their colour and size. All Products selected for purchase will be added to a Shopping Basket. To keep items in the Shopping Basket so that you can purchase them later, you must first create an online account and sign in to your account when placing your order. you can place an order without having an online account and/or without signing in, however all items will be removed from the Shopping Basket if you do not complete your purchase, and when you come back to our Website you will have to start anew.
3.2. You can edit any detail entered during the purchase process at any time before you confirm your order. Once the order has been confirmed it can no longer be modified or cancelled.
3.3. Your purchase shall be considered concluded only when you send your purchase order to Archivio Jam by clicking 'Purchase Now' at the bottom of the order confirmation page. To send your order, you will have to provide your personal details, including your name, address, email address and payment information. In addition, you will be prompted to confirm these Terms of Sale by ticking the relevant box. Please double check your order before submitting it to make sure it is correct, including the details of the Products being ordered, shipping costs, right of return (please refer to Art. 7 'Right of return'), warranty information and Privacy Policy.
3.4. After you have submitted your order, we will send you an email (hereinafter referred to as 'Order Confirmation') to confirm that we have received and processed it. You can access your orders at any time through the 'My account' link on our Website if you have an online account, otherwise you can contact our Customer Care Team on info@archiviojam.com.
Please note that the Order Confirmation does not signify acceptance by Archivio Jam of your order. We shall accept your order and charge you the price only after the Products have been shipped. If you pay by bank transfer, your Order will be processed as soon as we receive your payment. If you do not make your payment within 5 days we will cancel your Order. Upon receipt of your payment we will send you another confirmation email (hereinafter referred to as 'Shipment Confirmation') to inform you that your Order has been accepted and that the Products have been shipped. The invoice for your Order will be attached to the Shipment Confirmation email.
3.5. We reserve the right not to accept your Order without giving any reason if, in our opinion, you do not meet the requirements for sending a purchase order or if we have a legal dispute with you concerning a previous order or for any other legitimate reason. We also reserve the right not to accept and deliver orders that appear to have been submitted by dealers and/or distributors.
3.6. Each Product offered for sale on the Website is accompanied by a descriptive picture, together with its unit price, colours and sizes available. The pictures are for reference only. Please be aware that due to browser software, monitor resolution or other technical factor the pictures and colours of the Products sold on the Website may not correspond to the actual products. Archivio Jam shall not have any liability for pictures that are not 100% accurate because of the above-mentioned technical reasons.
4. AVAILABILITY
4.1. While we strive to guarantee the availability of our Products offered for sale on the Website, in exceptional cases some Products may not be readily available. You are advised to check availability of the Products offered for sale on the Website when you make your purchase. We will contact you if the Products you have ordered become unexpectedly unavailable.
4.2. If the Products you have ordered become temporarily unavailable, we will inform you by email within one working day of your order. In this case, we will not charge your payment card. If your card has already been charged for the purchase, we will issue a credit within five (5) days to the payment card account you used for sending your order. Please check with your bank to know how long it takes for the refund to appear on your payment card statement. We can in no way influence bank refund processing times. If you have made your payment by bank transfer, we will refund your money to the same bank account used for the purchase. If you have not yet made your payment, we will cancel your order and contact you.
5. PRICE AND PAYMENT
5.1. The Prices of the Products available for sale on the Website are in EUROS (€) for sales within the European Union.
5.2. All prices are inclusive of VAT. Shipping costs vary depending on the destination. We offer free delivery within Italy, and charge € 20,00 for delivery within the European Union. Shipping costs and any applicable tax will be shown on the payment page, in your Order Confirmation.
5.3. We accept payments by bank transfer, Multisafepay and PayPal.
5.4. If you pay by PayPal or Multisafepay, we will ship the Products only after PayPal or Multisafepay have authorized the payment. If you opt to pay by bank transfer, you can make your payment within 5 days, after which your order will be cancelled. Your order will be processed as soon as your payment is received.
5.5. All Products are delivered with an identification tag attached, which forms an integral part of the Product. Please do not remove the identification tag before you have verified that the Product you have received corresponds to your order, or if you decide to exercise your right of return in compliance with Art. 7 below.
6. DELIVERY
6.1. The Products will be shipped to the address you specified when making the order. For security reasons we do not deliver to PO boxes, nor accept orders if the identity and address of the consignee cannot be verified.
6.2. All orders will be delivered by a courier service selected by us (DHL or TNT), from Monday to Friday excluding local or national holidays. Before shipping the Products we will send you a Shipment Confirmation. Saturday delivery services may be available if offered by the courier. Saturday delivery service conditions are specified at the time of the offer.
6.3. The Products will be delivered to you within 1-5 working days from the Shipment Confirmation, depending on your shipping address and country of destination, and on the shipping method selected by you at the time of purchase. We shall not be liable for delays that are unexpected and/or attributable exclusively to the courier. Before shipping the Products to you, we may need to confirm your details with your payment card issuer. This operation usually takes no more than 24 hours, and we will do our best to minimize possible delays.
6.4. If you do not receive the Products within 7-10 (seven - ten) working days from the date of receipt of the Shipment Confirmation, please send an email to info@archiviojam.com.
7. RIGHT OF RETURN
7.1. You have the right to cancel your purchase without giving reasons and without penalty within fourteen (14) days of receipt of the Products purchased on the Website.
7.2. To exercise your right of return, you must communicate your intention to cancel your purchase to us by sending an email to info@archiviojam.com. You must return the Products in their original condition, as-new, to our Returns Centre (please refer to Art. 7.8 below). Returns delivered to our stores will not be accepted.
7.3. You will receive a refund provided the Products you are returning have not been used and/or washed, and are in exactly the same conditions you received them. They must also have all the original tags and accessories attached, and must be delivered with the original packaging, together with copy of the invoice/purchase receipt. If you wish to exercise your right of return for all Products purchased with the same order, you must return all Products together with the same shipment in a single package.
7.4. We reserve the right to check the returned Products and refuse them if we believe that they do not meet the requirements set out in Art. 7.3 above.
7.5. We will issue a complete refund to the payment card or bank account you used for your purchase as soon as possible, at the latest within 10 (ten) days of our first confirmation of receipt of the Products returned by You, provided the requirements set out in Art. 7.3 above have been met. In any case we will issue the refund as soon as you have proved that you have shipped the Products back to us.
7.6. To return the Products to us you must first of all inform us by email to info@archiviojam.com that the Products you wish to return are ready to be collected. We will prepare all the documents the courier needs in order to collect your parcel at the address specified by you when you made the purchase or at any other address. You will receive a return shipping label from us, which you must attach to your return parcel. Please check and keep a copy of the courier's receipt, which must be signed by the courier. For returns from Italy, shipping is charged to Archivio Jam, for returns outside Italy shipping is charged to the customer.

8. AMENDMENTS AND CORRECTIONS TO THESE TERMS OF SALE
8.1. We reserve the right to amend or correct these Terms of Sale, the Privacy Policy, the Right of Return Policy, the Products offered for sale on the Website and the prices of the Products at any time without prior notice. Please read the Terms of Sale and the Privacy Policy thoroughly every time you use our Website to purchase Products.
8.2. Although we strive to guarantee that the prices and all other information about the Products displayed on the Website are always accurate and up to date, there may still be occasional misprints, inaccurate statements or omissions (hereinafter referred to as 'Errors') regarding descriptions, prices, promotions, offers and availability of the Products. We reserve the right to correct any error and modify or update any Product detail at any time without notice, as well as to discontinue any offer and cancel any order containing such errors before delivery takes place.
8.3. If your payment card is charged for an order cancelled pursuant to Art. 8.2 above, we will inform you immediately by email (in any case no more than 24 hours of order cancellation) and issue a complete refund to your payment card (or bank account if the order was paid by bank transfer) within 14 (fourteen) days of the order cancellation.
8.4. All the above-mentioned amendments and/or corrections shall only apply to purchase orders sent after the date of such amendments or corrections by us.
9. CORRESPONDENCE OF ORDERS
9.1. On receipt of the order please check that the Products delivered match those you have ordered.
9.2. If you detect any discrepancy upon receipt of the order, including, by way of example, any tampering with or damage to the packaging, damage to the Products, missing items, non-conforming Products, faulty Products, etc. (hereinafter referred to as 'Defects'), you can notify them directly to the courier by adding and signing the relevant comment on the delivery note. In such event you will not be required to accept the Products, and may return them immediately to the courier.
9.3. If you detect any Defect after delivery, you may return the Products to us following the procedure described in Art. 10 below.
10. STATUTORY WARRANTY IN CASE OF NON-CONFORMING PRODUCTS
10.1. Archivio Jam's Products offered for sale on the Website are backed by a 24-month statutory warranty from the date of receipt by the Customer (hereinafter referred to as 'Statutory Warranty Period') covering any Product defect or non conformity. Without prejudice to any other remedy provided for by applicable laws, if during the Statutory Warranty Period it is established that a Product delivered to you is faulty or does not correspond to the Product actually ordered (hereinafter referred to as 'Faulty Product'), you have the right to return the Faulty Product to us and we will repair it fully free of charge. If the Faulty Product cannot be fully repaired, it can be replaced with a new one. To request full repair or replacement of the Faulty Product you are required to send us a photo of the fault.
10.2. Faulty Products to be repaired must be returned as follows:
(a) You are required to inform us of any fault or non-conformity of the Products within the Statutory Warranty Period by email to: info@archiviojam.com. Your email must include the Product details, together with a description and picture of the fault.
(b) We will arrange for the courier to collect the Product from you and deliver it back to you. Shipping costs shall be borne by us.
10.3. If you choose not to use the courier indicated by us, we shall not be liable for any loss occurring during shipping.

10.4. We reserve the right to inspect the Products returned in order to confirm the existence of faults and/or non conformities, and shall return them to the Customer if we determine that there is no defect or non conformity. In this event shipping costs for returning the Products back to the Customer shall be charged to the Customer.
11. ARCHIVIO JAM'S LIABILITY
11.1. The Products are offered for sale on our Website 'subject to availability'. Without prejudice to the statutory warranty pursuant to Art. 10.1 above, we provide no warranty, condition, commitment or term, express or implied, contractual or otherwise, regarding the conditions, performance, satisfactory quality or fitness for a purpose of the Products that exceed the Product description included in the purchase order, and all such warranties, conditions, commitments and terms of such nature are excluded to the fullest extent permitted by applicable law.
11.2. In no circumstance whatsoever shall we be liable for damage of any nature, including by way of example direct, indirect, incidental or consequential damage caused to the Customer and arising, whether directly or indirectly, from:
Customer’s use of the Website or inability to use the Website;
reliance by the Customer on the information contained in the Website;
errors, service disruptions, deletion or corruption of, or damage to files and emails, software errors, viruses or faults, operation or transmission delays, lack of communication, theft, destruction or non-authorised access to data, software or services used by us.
11.3. Without prejudice to Art. 11.1 and 11.2, nothing in these Terms of Sale shall exclude or limit our liability towards the Customer in the event of fraud, death or personal injury caused by negligence, breach of these terms under applicable consumer protection legislation or any other liability that cannot be excluded or restricted under applicable laws.
APPLICABLE LAWS AND JURISDICTION
12.1. These Terms of Sale are governed in every aspect by the laws of Italy. Any dispute relating to these Terms of Sale and/or arising out of their interpretation or execution shall be subject to the jurisdiction of the Court of Padova (Italy).
12.2. If any of the provisions of these Terms of Sale become invalid, non applicable or void for any reason whatsoever, they shall be deemed severable so that the remaining provisions remain valid and applicable.
